
Many foreigners and refugees in Turkey seek to obtain humanitarian residency, whether because they were rejected after applying for other types of residency, or for other reasons, but not realizing the conditions for applying for it will end up being rejected, and this is what many fear.
Humanitarian residence falls under the provisions of Articles 46 and 47 of the Aliens and International Protection Law, in addition to Article 44 of the executive regulations related to the Aliens and International Protection Law, and is provided according to several conditions, which are?
The child, if obtaining it achieves the highest interest for him.
It can be obtained by foreigners who were subject to a deportation decision outside the borders of Turkey, or who were prevented from entering it, and then it became clear that their exit from Turkey is not possible.
Foreigners who are not subject to a deportation decision outside the borders of Turkey, even if they fulfill the conditions for expulsion under Article 55 of the Aliens and International Protection Law, and they are:
A foreigner who proves that he will be subjected to torture in the country to which he will be deported, or that there is a death sentence against him, or any other inhumane practice awaiting him.
Foreigners whose life is seriously endangered by travel due to age, a certain health condition, or a woman’s pregnancy.
People who receive support because they are victims of human trafficking.
Foreigners who have been subjected to psychological, physical or sexual violence, until the stages of their treatment for that are completed.
Duration of human stay in Türkiye
Humanitarian residency is granted by the state leadership and with the approval of the Ministry of Interior for one year, subject to extension.
Reasons for refusing humanitarian residence in Türkiye
The residence permit shall be canceled or refused to be extended by the state leadership and with the approval of the Ministry if the conditions for granting the humanitarian residence permit cease to exist.
It should be noted that a foreigner who has obtained a humanitarian residence permit is required to register his residence address on the address system within a maximum period of 20 working days from the date of granting him a residence permit.
Humanitarian residence permit holders can apply to convert their residence into any type of residence except for long-term residence, if they fulfill the conditions necessary to obtain the required residence permit.
